RELEASE OF CLAIMS FOR PERSONAL INJURY OR DEATH

, am a guest at Monti Bay Lodge, LLC (the “Lodge”), [along with my minor child(ren) listed below, if applicable], and voluntarily choose to engage [and have my minor child(ren) engage, if applicable] in the following activities (collectively the “Activities” and each an “Activity”) available to me/us during my/our stay at the Lodge

• Walking outdoors;
• Using a watercraft, including any boat, canoe, or other marine vessel (motorized and/or not motorized);
• Using a vehicle, including any car, truck, van, all-terrain vehicle, motorcycle, bicycle, or other form of wheeled ground transportation; and

I have read and understand the Lodge’s Vehicle Rental Policy, Watercraft Rental Policy, and Terms and Conditions.

I AM AWARE THAT THE ENVIRONMENT SURROUNDING THE LODGE IS WILDERNESS WITH WILD ANIMALS AND UNCERTAIN WEATHER THAT CAN EACH BE DANGEROUS. I AM AWARE THAT MY/OUR PARTICIPATION IN ANY OF THE ACTIVITIES IS ALSO DANGEROUS, WITH EACH INVOLVING A RISK OF SERIOUS INJURY OR DEATH. I ACCEPT ALL SUCH RISKS.

I/WE WILL NOT PARTICIPATE IN ANY OF THE ACTIVITIES WITHOUT HAVING SUFFICIENT INFORMATION ON THE RISKS OF DOING SO AND BEING CONFIDENT IN MY/OUR ABILITIES TO HANDLE ANY SITUATION THE ACTIVITY MAY INVOLVE.

As lawful consideration for being permitted by the Lodge to participate in any of the Activities, I agree that I, and all those who may make a claim on my behalf or because of a legal right they have to do so, will not make a claim against, sue, attach the property of, or prosecute for injury or damage, the Lodge, as a result of my participation in any of the Activities.

Accordingly, I release and discharge the Lodge from all actions, claims or demands, I, and all those who may make a claim on my behalf or because of a legal right they have to do so, now have or may hereafter have for injury or damage resulting from my participation in any of the Activities.

I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN THE LODGE AND ME. I HAVE SIGNED THIS RELEASE OF MY OWN FREE WILL.
